SMS Text Message Consent

Thank you for using Openmelo ("we," "us," or "our"). This SMS/Text Messaging Consent ("SMS Consent") explains how we collect consent to send you text messages and what you agree to by providing your mobile phone number.
This SMS Consent is part of our Terms of Service and Privacy Policy. By enrolling in our SMS program, you agree to this SMS Consent in addition to those agreements.
1. Who We Message
We send SMS messages only to our own business customers and their authorized users, such as:
- Business owners
- Managers
- Staff who are added as users in the Openmelo platform
We do not use this SMS program to message your customers (the callers to your business) directly.
2. How You Provide Consent
You give us permission to send you SMS messages when you:
- Enter your mobile phone number in our web application or other online form; and
- Affirmatively agree (for example, by checking a box or clicking a button) that says you consent to receive text messages from Openmelo.
By taking these steps, you consent to receive SMS messages at the number you provide, including by automated means where permitted by law.
You represent that you are the lawful owner of the phone number you provide, or that you are authorized to provide that number and receive messages on that device.
3. Types of Messages You Will Receive
Our SMS program is intended for transactional and service-related messages, including (as applicable):
- Real-time alerts related to live phone calls handled through Openmelo
- Call summaries and suggested replies to callers
- Account notifications (e.g., changes to settings, security alerts)
- Service-related notifications and operational updates about the Openmelo platform
We do not use this program to send generic marketing campaigns or promotional offers by default.
If we ever introduce marketing messages, we will obtain any additional consent required by law and clearly distinguish marketing opt-in from service/transactional opt-in.
4. Message Frequency
Message frequency will vary based on your usage of Openmelo and your configured settings, but may include multiple messages during periods of high call activity.
You can always control message frequency by:
- Changing your notification settings inside the Openmelo app; and/or
- Opting out of SMS as described below.
5. Charges and Carrier Information
Message and data rates may apply according to your mobile carrier's plan.
- We are not responsible for any SMS, data, or other fees charged by your carrier.
- SMS services are provided on an "as is" basis and may not be available in all areas or at all times.
- Delivery of SMS messages is subject to effective transmission by your carrier and is outside of our control.
Participating carriers may change from time to time.
6. How to Opt Out
You may opt out of receiving SMS messages from us at any time.
- Reply "STOP" to any message you receive from us to cancel SMS for that number.
- After you send "STOP," we may send a final confirmation message to confirm that you have been unsubscribed.
- No further messages will be sent to that number, except as required or allowed by law (for example, to confirm your opt-out).
You may also contact us at contact@openmelo.com and request that we remove your phone number from our SMS program.
If you have multiple phone numbers or accounts with us, you must opt out separately for each number.
7. How to Get Help
If you need help regarding our SMS messages:
- Reply "HELP" to any message you receive from us; or
- Contact us at contact@openmelo.com.
We will respond with additional information or support options.
8. Your Responsibilities
By providing your mobile number and consenting to SMS messages, you agree to:
- Provide accurate and up-to-date contact information.
- Notify us promptly if you change or deactivate your mobile number.
- Be solely responsible for any messages sent to a number that you no longer control if you did not notify us of the change.
We are not responsible if messages are accessed by someone who has access to your device.
9. Privacy
We handle information collected through our SMS program in accordance with our Privacy Policy.
- We may log message content, timestamps, and delivery information to operate and improve the service.
- We do not sell your phone number to third parties for their independent marketing purposes.

10. Changes to This SMS Consent
We may update this SMS Consent from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page; and
- Provide additional notice as required by law (for example, in-app notice or email).
Your continued participation in our SMS program after changes become effective constitutes your acceptance of the updated SMS Consent.
